Hopping Green & Sams works with clients to manage and address the risks, emerging challenges, and favorable opportunities presented by climate change.

For example, many businesses and public entities are evaluating climate change issues, including greenhouse gas reduction strategies, whether voluntary or due to complex regulatory requirements. Hopping Green & Sams fully addresses such matters through a deep understanding not only of air quality, but also of energy generation and other greenhouse gas-emitting facilities; available greenhouse gas control technologies and mitigation strategies; adaptation and resilience strategies; renewable energy resources and facilities; water resources; land use; and the interaction among state and federal regulatory agencies across regulatory program areas.

Our experience allows us to effectively identify, understand, and address these complex requirements, and develop meaningful strategies to meet specific client needs.

Areas of Service

We represent many regulated interests directly affected by climate-related concerns through the legislative process, state and federal agency rulemaking processes, project permitting and, when necessary, litigation. 

Our lawyers have been actively engaged for decades on climate issues, particularly when state and federal government focus on developing regulatory approaches. The State of Florida, for example, has formed several collaborative governmental bodies over the last 20 years to evaluate and recommend specific requirements. We have represented clients in the legislative process that compelled these efforts, during the specific collaborative efforts, and in subsequent rulemaking and implementation.

Hopping Green & Sams and its clients have also been engaged on EPA’s numerous regulations regulating greenhouse gases, from both new and existing facilities. We have the technical and regulatory expertise to participate meaningfully in these rulemaking processes, and litigate when final rules are arbitrary and capricious, or exceed statutory authority. Our lawyers also have extensive experience working with the State of Florida, and affected sources to implement such federal requirements.

Our lawyers also assist clients with developing voluntary greenhouse gas reduction strategies, including obtaining regulatory approvals to make desired process or fuel changes at their facilities, and gain appropriate credits for specific renewable projects.
