U.S. Fish and Wildlife Service Eagle Incidental Take and Take of Eagle Nests Revisions

On December 16, 2016, the United States Fish and Wildlife Service published its revisions to regulations for Eagle Incidental Take and Take of Eagle Nests. The overall goal of The Bald and Golden Eagle Protection Act (Eagle Act) is to “enhance protection of eagles throughout their ranges through implementation of mitigation measures that avoid and minimize, and compensate for, adverse impacts from otherwise lawful activities.” The Eagle Act prohibits take of bald and golden eagles except in certain circumstances authorized the Secretary of the Interior (Secretary). The Secretary may allow takes of eagles for the purposes of protecting other particular interests, so long as the takes are consistent with the goal of eagle preservation.
