HGS Legal Team Applauds Judge’s Ruling Upholding Florida Nutrient Rule

On June 7, 2012, Administrative Law Judge Bram Canter issued a final order rejecting legal challenges against the Florida Department of Environmental Protection’s (FDEP’s) proposed numeric nutrient standards and existing narrative nutrient criterion. The Environmental Committee of the Florida Electric Power Coordinating Group (FCG) had intervened in support of the state nutrient rules and presented evidence rebutting challenges made by Sierra Club and other petitioners.  Winston Borkowski and David Childs were counsel of record for the FCG.  DEP’s nutrient rules are now ready for final review by EPA.
