HGS Client Tarmac America, LLC Prevails in Two Challenges to Proposed King Road Mine in Levy County

HGS Attorneys Frank Matthews, Vinette Godelia, and Mike Collazo have successfully defended two challenges – a circuit court challenge and an appellate challenge – to Tarmac America, LLC’s local land use special exception approval for its proposed King Road mine in Levy County, Florida.

On February 15, 2012, the First District Court of Appeal entered an order denying a petition for writ of certiorari challenge brought by the neighboring Town of Yankeetown.

Also, in December 2011, the Eighth Judicial Circuit granted Tarmac’s motion for summary judgment in a comprehensive plan consistency challenge brought by W.A.R., Inc. (also known as “Withlacoochee Area Residents”), which is now pending review in the First District Court of Appeal.
