HGS celebrates Mosaic’s win before 11th Circuit Court of Appeals

HGS celebrates client Mosaic prevailing last week in a challenge brought by various environmental groups. On November 4, the Federal 11th Circuit Court of Appeals upheld the U.S. Army Corps of Engineers’ decision to issue a Section 404 Clean Water Act permit that enables Mosaic to continue mining operations in Hardee County. The Court rejected arguments raised by the Center of Biological Diversity and others that the Corps’ review under the National Environmental Protection Act was inadequate, as well as brushing aside challenges brought under the Endangered Species Act. HGS attorneys Susan Stephens and Amelia Savage assisted in representing Mosaic on this appeal.
