HGS Attorneys Speak on Clean Water Act Rulemaking, Jurisdiction

Winston K. Borkowski and Susan L. Stephens, attorneys with Hopping Green & Sams (HGS), recently participated in a webinar jointly sponsored by the Society of American Military Engineers and the Florida Association for Water Quality Control regarding U.S. Environmental Protection Agency and U.S. Army Corps of Engineers rulemaking under the Clean Water Act (CWA).  On December 16, 2013, Winston and Susan spoke to participants regarding the efforts of these agencies to amend regulatory definitions that purport to clarify the scope of federal jurisdiction of “waters of the United States” (WOTUS) under the CWA.  The agencies are attempting to resolve long-standing uncertainty about which water bodies and activities are regulated by the CWA.  The webinar focused on the potential far-reaching implications of this preliminary rulemaking effort on the design and permitting of development, mitigation, and restoration systems in Florida.
