Florida Legislature Enacts Two Year Permit Extension

On Friday, May 2nd, the Florida Legislature passed CS/HB 7023 which, among other things, includes a further two year permit extension for certain development related permits. A veto is unlikely but the timing on becoming law depends on when the Senate President and Speaker of the House submit the bill to the Governor for action.

To be eligible, a person must have a building permit, permit from the Florida Department of Environmental Protection, or a water management district issued permit under part IV or chapter 373, Florida Statutes. The permit to be extended must have an expiration date between January 1, 2014 and January 1, 2016. And the total amount of time that the permit may be extended is 4 years, including use of this 2 year period along with any prior legislative extension of permits. This extension does not apply to development of regional impact entitlements that were previously extended by operation of section. 380.06(19)(c)2, Florida Statutes.

Importantly, in order to take advantage of this new extension, the permit holder must provide written notification to the issuing agency on or before December 31, 2014, identifying the specific permit being extended and the likely timeframe for acting upon the permit.
