FDEP Planning Rulemaking to Obtain GHG Permitting Authority

The Florida Department of Environmental Protection (FDEP) intends to undertake rulemaking to issue permits that cover greenhouse gases (GHG) under the Clean Air Act’s prevention of significant deterioration program (PSD).  PSD permitting is currently bifurcated in Florida, with Region IV of the U.S. Environmental Protection Agency issuing GHG PSD permits, while FDEP issues PSD permits for all other regulated pollutants.  Further details will be forthcoming, but FDEP may have the authority to issue PSD permits covering GHGs by early 2014.
