On July 26, 2017, the U.S. Environmental Protection Agency (EPA) published its proposal to retain the current national ambient air quality standards (NAAQS) for nitrogen oxides (NOX) as adequately protective of public health. Florida is in attainment with the current standard. The NOx NAAQS was last reviewed and revised by EPA in 2010, and the Clean Air Act requires review of the NAAQS every five years. EPA was sued in 2016 for failure to timely perform the required review and is currently subject to a judicial consent decree that requires final action by April 6, 2018.
