DEP Publishes Proposed Rule Revisions Related to Title V Fee Calculations and Annual Operating Reports

The Florida Department of Environmental Protection (DEP) has published proposed revisions (OGC No. 13-1120 & OGC No. 13-1121) to rules 62-210.370, 62-210.900, 62-213.205, and 62-213.900, Florida Administrative Code.  The purpose of the proposed revisions is to conform with recent revisions to section 403.0872, Florida Statutes, which, as amended by the Florida Legislature in 2013, provides that annual operation fees paid by Title V sources must be based on actual emissions rather than permitted emissions.  The proposed rules also require each source to submit its annual operating report (AOR) using DEP’s electronic AOR software, unless a technical or financial hardship can be demonstrated.

Comments and requests for public hearing on the revisions are due to DEP by November 25, 2013.
