DEP Proposes Rule Revisions Reducing Title V Air Emission Fees

On December 13, 2012, the Florida Department of Environmental Protection (DEP) published notice of proposed revisions to Rule 62-213.205, Fla. Admin. Code, that would reduce annual emission fees that Title V facilities must pay for calendar year 2013 emissions.  A copy of DEP’s proposed revised rule is available here.  As anticipated, the proposed revisions reduce the applicable fee from $30/ton to $27/ton; however, in a change from prior indications, the reduced fee would only apply for calendar year 2013 emissions.  It is currently anticipated that this change in approach is the result of DEP’s consideration of an alternative option to addressing appropriate reductions in Title V fees in future years, and that a permanent reduction will still likely be pursued.  DEP will conduct a hearing on this proposal if requested by January 3, 2012.
